1. Provider
These general terms and conditions of sale (the "Terms") govern the golf lessons, accompanied rounds, programs and gift vouchers offered by Alexis Weizman, golf instructor (the "coach"), at Golf de Paris, 115 rue de Buzenval, 92380 Garches, France.
The business is run as a sole proprietorship, under the French micro-entreprise scheme.
The coach can be reached by email at alexisweizman82@icloud.com and by phone on +33 6 09 78 48 32.
2. Scope
The Terms apply to every booking made with the coach, whatever the channel, online calendar, request form, phone or message. They are available on the website at all times and are brought to the client's attention before any booking.
Any booking implies full acceptance of the Terms in force on the date of the booking. The client is the person who makes the booking. When booking for other participants, the client undertakes to inform them of the Terms and is responsible for paying for all the places booked.
3. Services and prices
Prices are in euros. They are those shown on the website on the day of the booking.
A private lesson costs €70 per hour. A duo lesson costs €90 per hour for two people. A lesson for three people or more costs €100 per hour for the group. The accompanied 9-hole round at Golf de Paris costs €150.
Beginner programs cost €150 for 1 day and 3 hours, €300 for 2 days and 6 hours, €450 for 3 days and 9 hours. Green Card programs cost €450 for 3 days and 9 hours, €600 for 4 days and 12 hours, €750 for 5 days and 15 hours. Improvement programs cost €150 for 1 day and 3 hours, €300 for 2 days and 6 hours, €450 for 3 days and 9 hours, €750 for 5 days and 15 hours.
VIP one-to-one programs cost €400, €800, €1,200, €1,600 and €2,000 for 1 to 5 days, that is 3 to 15 hours. VIP duo programs cost €300, €600, €900, €1,200 and €1,500 per person for the same durations.
Access to the golf course is charged by the club at €14 per day and per person, with unlimited range balls. It is added to the price of hourly lessons and is paid on site, to the club. Programs are not concerned, as daily access and balls are included in their price. The access fee is set by the club and may change without the coach being responsible for it.
The content of each option, duration, group size, inclusions and program, is the one described on the option's page of the website on the day of the booking.
4. Group sizes and program durations
Each program is open to a minimum of 2 and a maximum of 4 people, except the VIP one-to-one program, reserved for one person, and the VIP duo program, limited to two people.
When only one person registers for a program intended for a group, the coach decides whether to run the program or cancel it. He informs the client of his decision at the latest 7 days before the program starts.
If it goes ahead, the daily duration of the program is reduced by one third, that is 2 hours per day instead of 3. If it is cancelled, article 8 applies.
The video debrief sent after the program applies to the improvement, VIP one-to-one and VIP duo programs.
5. Booking and formation of the contract
Bookings are made through the coach's online calendar, the website's request form, by phone or by message.
A booking made through the online calendar is firm as soon as it is validated, which is confirmed by email. A request sent through the form, by phone or by message only binds the parties once the coach has confirmed it in writing, by email or by message.
The contract is concluded on the date of that confirmation. For a program, the place is only definitively booked once the deposit provided for in article 6 has been received.
6. Payment
Hourly lessons and the accompanied round are paid at the latest at the start of the session, unless paid online at the time of booking.
For a program, a deposit of 30% of the price is paid at booking. The balance is paid at the latest on the first day of the program, before it starts. Sums paid in advance are deposits ("acomptes") and not "arrhes" within the meaning of article L. 214-1 of the French Consumer Code. Their payment firmly commits both parties.
Accepted payment methods are given at the time of booking. A gift voucher is paid in full at purchase.
If payment is not made when due, the coach may refuse to start or continue the service, without the client being entitled to any compensation.
7. Cancellation or rescheduling by the client
Hourly lessons and accompanied round
A lesson or an accompanied round can be cancelled or rescheduled free of charge up to 24 hours before the appointment, through the online calendar, by email, by message or by phone. After that, or in case of absence, the full price of the session is due.
Programs
A program is cancelled by the client in writing, by email or by message. The following terms apply depending on the date the request is received.
- More than 30 days before the start of the program, the sums paid are refunded in full.
- Between 30 and 8 days before the start of the program, the deposit is kept by the coach. Any balance already paid is refunded.
- Less than 8 days before the start of the program, or in case of absence, the full price of the program is due.
The client may ask once to move the program free of charge, provided the request is made more than 8 days before the start of the program and subject to availability. The rescheduled program must take place within 6 months of the original date.
A program that has started and is interrupted because of the client, for whatever reason, remains due in full. The client may however propose a replacement participant until the day before the program, provided their level matches the option.
Late arrival
If the client arrives late, the session ends at the scheduled time and the time lost is not made up. Arriving more than 15 minutes late without notice is treated as an absence.
8. Cancellation or rescheduling by the coach
The coach may have to cancel or reschedule a session or a program. He informs the client as soon as possible. The session or program is then moved to another date agreed together, at no cost to the client.
If no date suits the client within 3 months of the original date, the sums paid for the service not delivered are refunded in full.
9. Weather, golf course closure and force majeure
Golf is played outdoors. Rain alone does not justify cancelling a session. The coach may however suspend or cancel a session when conditions endanger the participants' safety, in particular in case of storm, lightning, violent wind or an unplayable course, or when the golf club closes all or part of its facilities. His decision is binding for safety reasons.
In these cases, the session or part of the session not delivered is rescheduled free of charge to a date agreed together. If no date can be agreed within 3 months, the part not delivered is refunded pro rata. No other compensation is due by either party.
Neither the coach nor the client is liable for a failure caused by force majeure within the meaning of article 1218 of the French Civil Code. Obligations are then suspended, and later rescheduled or refunded as set out in the previous paragraph.
10. Fitness, safety and conduct
The client declares being fit to play golf. Before the session, the client informs the coach of any health problem, injury, treatment or pregnancy that could affect their practice. The coach may adapt, interrupt or refuse a session if he considers that the safety of the client or others is at stake.
The client follows the coach's safety instructions, the internal rules and etiquette of Golf de Paris, and the safety distances on the range and on the course. The coach may exclude, without refund, a participant whose behaviour endangers others or prevents the session from running properly.
A minor may only take part with the written consent of their legal guardian, who remains responsible for them outside session hours. The legal guardian, or a person they designate, accompanies the minor on arrival and collects them at the end of the session.
11. Liability and insurance
The coach undertakes to use all necessary means to ensure the quality and safety of his teaching. The client's progress depends on their commitment, practice and condition. The coach is bound by an obligation of means and guarantees no result, in particular in terms of level, handicap or success in the Green Card assessment.
The coach is not responsible for the client's personal belongings, bags, equipment and vehicles, nor for damage caused by the client to third parties, to the golf club's facilities or to loaned equipment. The client remains responsible for the damage they cause and is advised to hold civil liability insurance, which is included in particular in the French Golf Federation licence.
Equipment loaned by the coach is returned at the end of the session in the condition in which it was handed over. Damage resulting from use contrary to instructions may be charged at the cost of repair or replacement.
Golf de Paris is solely responsible for its facilities, its course and its access rules.
These limitations do not apply to bodily injury or to losses resulting from a fault of the coach, for which the client retains the right to compensation under general law.
12. Videos and image rights
Videos recorded during sessions are used for teaching only. They are sent only to the client concerned and are never published without their prior written consent, or that of their legal guardian for a minor.
Any photo or video of a client intended for the coach's website or social media is subject to a separate written consent, which the client may withdraw at any time for the future.
13. Gift vouchers
Programs and lessons can be given as gift vouchers. The voucher states the service offered, its value, the beneficiary's name and its expiry date.
A gift voucher is valid for 12 months from purchase. It can be used once, by booking with the coach and subject to availability. It is issued in the beneficiary's name but may be passed on to a relative, provided the coach is informed before the booking.
A gift voucher can neither be refunded nor exchanged for cash, except when the right of withdrawal provided for in article 14 is exercised. A voucher not used by its expiry date is lost. On request made before that date, the coach may grant a single 3-month extension.
Once a session has been booked with a gift voucher, the cancellation terms of article 7 apply to the beneficiary.
14. Right of withdrawal
In accordance with article L. 221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to lessons, accompanied rounds and programs, which are leisure activities provided on a set date or during a set period. Any booking of a dated session is therefore firm as soon as it is confirmed, subject to the cancellation terms of article 7.
A gift voucher bought remotely, with no service date set, may be withdrawn from within 14 days of purchase, without giving reasons and at no cost, by a written statement sent to the coach by email. The refund is made within 14 days of receipt of the request, using the payment method used for the purchase. If a session was booked and delivered with the voucher at the client's express request before the end of that period, the amount corresponding to the service provided remains due.
15. Personal data
Data provided when booking is used only to manage the service and the relationship with the client. How it is processed, how long it is kept and the client's rights are described in the website's privacy policy.
16. Complaints and mediation
Any complaint is sent to the coach in writing, by email. The coach undertakes to reply within 15 days.
In accordance with article L. 612-1 of the French Consumer Code, a consumer client may use a consumer mediator free of charge to resolve amicably a dispute that could not be settled directly with the coach. The client must first have sent a written complaint to the coach, and must refer the matter to the mediator within one year of that complaint.
The competent consumer mediator is the Association des Médiateurs Européens (AME CONSO), 11 place Dauphine, 75001 Paris, France. A case can be submitted online on its website, www.mediationconso-ame.com, or by post to that address.
17. Governing law and disputes
The Terms and the contracts concluded with the coach are governed by French law.
Failing an amicable solution, the dispute is brought before the competent court under ordinary rules. A consumer client may also, at their choice, bring the matter before the court of the place where they lived when the contract was concluded or when the harmful event occurred.
18. Miscellaneous
If a clause of the Terms is declared void or unenforceable, the other clauses remain in force.
The coach may amend the Terms at any time. The applicable Terms are those in force on the date of the booking.
